Examples include witness fees, expert fees and expenses, expert advisers' fees, and the costs of transporting and preserving seized property. The law also includes the fees and expenses of public defenders, legal representatives and authorised representatives.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Not all expenses related to the proceedings are criminal costs, and the law specifically highlights some exceptions. The cost of production is not a criminal cost, it is borne by the State. The same applies to the cost of bringing a person before the courts: it is not a criminal cost either, but must be borne in accordance with special rules. Nor are costs relating to the participation of a sponsor or the use of the mother tongue (interpreter's fees and translation costs) criminal costs.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>Who bears the criminal costs as a general rule?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In the judicial phase, the general rule is that the person found guilty by the court bears the criminal costs. If the defendant is found guilty or found liable for an offence, the court will order him to pay the criminal costs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, this does not mean that the debtor automatically pays everything. The law makes a distinction depending on how the proceedings end.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>What happens in case of suspension or termination?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">If the proceedings do not end in a judgment, the rule on costs may be different. In cases where the accused is acquitted in whole or in part, the proceedings are terminated or a special form of procedure is in place, the State may be liable for all or part of the criminal costs. However, the costs arising from the failure to act on the part of the party to the proceedings may still be charged to him.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In practice, this means that it is not enough to look at \u201ewho won\u201d in the end. You also have to look at why the costs were incurred and whether they are related to a party's failure to act or procedural conduct.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>Can costs be borne by someone other than the debtor?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Yes. For example, if a person who has been summoned fails to appear without good reason and causes extra costs, he or she may be liable for the criminal costs incurred. This can also apply to witnesses, experts or other participants in the proceedings, under certain conditions. The same logic applies if someone's conduct causes the proceedings to be delayed or frustrated.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So criminal costs are not only a matter for the accused: in some cases, other parties to the proceedings may also be liable to pay the costs caused by their own conduct.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>Is a discount available?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A reduction in costs may be granted to a person who is unable to pay all or part of the criminal costs because of his or her income and wealth. The aim of the legislation is to ensure that financial situation does not in itself constitute an obstacle to the exercise of rights or access to defence.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This can be particularly important in cases where there are high expert costs, defence fees or other significant expenses.<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>Criminal proceedings can involve not only legal but also material consequences.
