The liquidation procedure is a tool that can be used against a debtor company to recover debts. The necessary prerequisite for the opening of the proceedings is the sending of a payment notice to the debtor, after which the application can be filed.\u00a0<\/span><\/p>\n

The main purpose of liquidation proceedings is to wind up insolvent companies without legal success, but they can also be used as a form of debt management against a debtor that is actually active and has assets. The initiation of proceedings forces the debtor company to pay its debts if it does not want to be liquidated.\u00a0<\/span><\/p>\n

How do we work?<\/b><\/h2>\n

The first step in the procedure is to determine whether the recovery of the claim can be most effectively enforced by initiating winding-up proceedings. In order to do this, we will hold a preliminary consultation with the client to understand the circumstances and the claims.<\/span><\/p>\n

We determine whether the conditions for initiating the procedure are met. If a payment notification has not yet been sent, we prepare and send it to the debtor. It is also essential for this procedure to establish that the debtor company has not contested the claims against it and that the time limits have been respected.<\/span><\/p>\n

If the conditions are met, we will prepare the necessary application to open winding-up proceedings.\u00a0<\/span><\/p>\n

The procedure<\/b><\/h2>\n

  • Consultation
    \n<\/b>Each case starts with a preliminary consultation, where we discuss the client's objectives, circumstances and the legal solutions available. If the client wishes to continue working with us, the consultation fee will be credited against the overall case fee.<\/li>\n<\/ul>\n

    • Preparing a payment notice
      \n<\/b>We will prepare a payment notice in accordance with the terms of the winding-up proceedings and send it to the debtor. If the debtor is still unwilling to pay after receiving the payment notice, we will initiate liquidation proceedings.<\/li>\n<\/ul>\n

      • Preparation of the application
        \n<\/b>Once we have verified that there are no grounds to exclude the opening of winding-up proceedings, we will prepare the application and submit it to the court.<\/li>\n<\/ul>\n

        The court notifies the debtor of the application and invites him to make a statement, who must settle the debt within the statutory time limit. If the debtor settles the debt and the creditor withdraws his application, the court terminates the winding-up proceedings. Otherwise, the court will order liquidation.\u00a0<\/span><\/p>\n
