Preparation of real estate sale and purchase contracts, attestation of documents, handling land registry procedures

Buying a property is a complex process. Legislation requires a written contract of sale, countersigned by a lawyer, with mandatory contents, for the sale to be valid.

The procedure for the sale of the property can be summarised as follows:

  1. The conclusion of an agreement between the parties: The parties agree on the purchase price, the payment dates and schedule, the timing of the transfer of possession, and any other terms that are relevant to their agreement (for example, the fate of the furniture in the property).
  2. Check the title deeds of the property: In all cases, the lawyer will check the title deeds of the property from the register and check the rights and encumbrances on the property. The parties, especially the seller, must make a declaration to this effect in the contract of sale. In addition, one of the validity requirements on the day of the conclusion of the contract of sale is to consult and check the title deeds in order to ensure that they are in order.
  3. Transfer of reservation: If the parties agree on a clause, the deposit is included in the purchase price. The deposit shall be paid at the earliest at the time of signing the contract, in accordance with the applicable rules.
  4. Preparation of a draft contract: The lawyer will always draw up a draft contract and send it to the parties for their comments. During this process, it is possible to make changes and to consult each other in order to achieve the best possible contractual terms for everyone.
  5. Finalising the contract: At this point, the lawyer will also check that the contract complies with the law and finalise it after consultation.
  6. Contract conclusion, land registry administration: Once the contract has been signed and countersigned, the lawyer submits the contract and the necessary annexes to the Land Registry. He then liaises continuously with the land registry authority to ensure that ownership is properly registered on the basis of the sales contract.
  7. Land registry decision: The land registry issues a decision to remove the seller's title from the register and the buyer's title is registered in accordance with the sale contract.
